NOTICE OF PROPOSED BOARD OF HEALTH REGULATION CHANGE REGARDING TOBACCO SALES AND EXPOSURE

The Falmouth Board of Health will hold a hearing on Monday, March 1, 2021 at 5:00 p.m. to vote on proposed changes to Falmouth’s tobacco regulations which restrict both the sales of and the exposure to tobacco:

Regulation of the Falmouth Board of Health Restricting the Sale of Tobacco Products and Nicotine Delivery Products

Regulation Prohibiting Smoking in Workplace and Public Places

Copies of these proposed regulations can be provided by visiting the Falmouth Health Department M-F 8:00-4:30 located at 59 Town Hall Square Falmouth MA 02540.  Copies can also be mailed by calling 508 495-7485.  Interested parties can also visit the Health Department’s webpage at www.falmouthma.gov under tobacco sales and regulations.

Some of the changes not otherwise previously covered in the town’s existing tobacco regulations are as follows:

Cap/ limit on the number of annual tobacco permits issued by the Falmouth Board of Health/ Health Department to the current number of 35 permits.  In the future, the total number of tobacco permits in the town of Falmouth can be reduced by two mechanisms:

Repeated violations by a permit holder

Failure to renew by the annual permit’s expiration date.

Fine structure for violations increased to be in line with the state regulation.  First sales offense $1,000, second offense $2,000, etc.

Nicotine content in electronic delivery systems cannot exceed 35 milligrams per milliliter

Prohibition of smoking bars.

In accordance with the Governor’s Order Suspending Certain Provisions of the Open Meeting Law, G. L. c. 30A, § 20, relating to the 2020 novel Coronavirus outbreak emergency, the March 1, 2021 public hearing on this matter shall be physically closed to the public to avoid group congregation. Alternative access to this meeting shall be provided in the following manner:

The Town of Falmouth, acting through the Human Services Department, invites proposals from public or private, state and federally recognized nonprofit agencies, or partnerships to enter into a contract with the Town of Falmouth to provide projects, programs or services that will address the Mental Health Needs and Substance Use related needs for the Town of Falmouth for Fiscal year 2022. Two separate RFPs are issued in the stated categories of Mental Health Needs and Substance Use Related Needs.

This solicitation is being conducted in accordance with the provisions of Massachusetts General Laws (MGL) Chapter 30B.  If it becomes necessary to revise any part of this RFP or otherwise provide additional information, an addendum will be issued to all prospective responders who received copies of the original request.
