Privacy Policy

We take your privacy very seriously and will never sell, rent, or otherwise disseminate your personal information without your express consent.

Privacy and Your Account. Registration data and other information about you are subject to our Privacy Policy. Your information may be stored and processed in the United States or any other country where Falmouth Publishing Co, Inc. has facilities, and by subscribing to a Service, you consent to the transfer of information outside of your country. If your access to a Service has been provided by or through a third party (for example, your employer or an education institution where you are a student) (each, a "Third Party"), the Third Party may have provided us with information about you to enable us to provide you with access to the Service and distinguish you from other subscribers (such as your email address or name). If you access a Service using a password, you are solely responsible for maintaining the confidentiality of that password. If you provide someone else with access to your password to a Service, they will have the ability to view information about your account and make changes through the website for the Service. Similarly, if you tell someone the answer to your security question for a Service, they will be able to request information about your account and make changes through Customer Service. You agree to notify us promptly if you change your address or email so we can continue to contact you and send any notices required hereunder. If you fail to notify us promptly of a change, then any notice we send to your old address or email shall be deemed sufficient notice.

Personal Information

Website registration

Registration at our website requires a valid e-mail address, username and password. If you are a subscriber, your subscription number is attached to your registration.

You may add additional personal information to your registration profile. This information is voluntarily provided and is not required to receive any services from us.

Website usage: Any content shared by you may be stored under your registration. Also stored under your registration will be any e-mail newsletters you have chosen to receive, saved items, follow notifications and calendar of event submissions. Automated technologies to collect and store this data may include third-party cookies, server logs and other similar technologies.

Due to the limitation on content provided for free to non-subscribers, content viewed by you will be stored under your registration if you are not a subscriber. This will also allow you to view an article you have already viewed without it counting down your free looks.

Comments on website: Any comment made by you and approved by us will show on the website with your username.

Subscription

Identity and Contact Data: A subscription to any one of our newspapers (The Falmouth Enterprise, The Mashpee Enterprise, The Sandwich Enterprise, The Bourne Enterprise), requires that you provide us with your first name, last name, delivery/mailing address, billing address, e-mail address and telephone number.

Financial Data: Financial data needed to purchase a subscription would include payment card details.

Transaction Data: This includes details about payments and the services you have purchased from us.

In processing your order and managing your payment methods, we may need to share your information with a third-party service provider. Payments are proessed by Paypal and Authorize.net.

Gift subscriptions: Before you use the personal information of another person, you must obtain that person’s consent to both the disclosure and the processing of that information in accordance with this privacy notice. If you provide us with that personal information, you acknowledge that you have the other person’s permission to do so.

Statistics Data: We gather data that is included in statistics about our website users. Examples include browser type and version, browser language, operating system, date/time stamp, time zone settings, basic geolocation, device type, unique device identifiers, referring/exit pages, browse plug-in types and versions, operating system and platform on devices used to access our services.

We may use third-party applications and automated technologies (for example, Google Analytics) to determine how often readers access our content with the purpose of gaining readership and providing interesting content.

We may collect, use and share statistical or demographic data for any purpose. This data may be derived from your personal information but does not directly or indirectly reveal your identity.

Data collected from European Union (EU)/European Economic Area (EEA)/Switzerland

We do not collect personal information on race or ethnicity; sexual orientation; religious or philosophical beliefs; political opinions; information about your health, genetic and biometric data; information about criminal convictions and offenses; sex life; or trade union membership.

If the personal information needed to provide our services is refused, we will not be able to provide that service (delivery of our print edition, viewing of our e-edition, viewing of our web content).

Website Audience

Our website serves current and past residents of the Upper Cape. Visitors to the Upper Cape area may also have an interest in our website and the advertising on it.

Our website is not intended specifically for residents of the European Union (EU)/European Economic Area (EEA)/Switzerland.

Security Policy

Third Party Web Sites, Services and Software. We may link to, or promote, web sites or services from other companies or offer you the ability to download software from other companies. You agree that we are not responsible for, and do not control, those web sites, services and software.

Your personal information is always safe. Our software is the industry standard and among the best software available today. It encrypts all of your personal information, including your name, and address, so that it cannot be read over the internet.

Comments and Moderation

User Moderation: In order to keep the discussions on topic we have implemented a report feature which is there to allow members to report comments they feel may be in violation of these policies. All reported comments will be assessed by the web team at Falmouth publishing, and at that time we will make a final decision to either hold the comment, if we determine it to not be in line with our policies, or put it back on the site once a comment has been approved by the web team it cannot be reported again. Users who are found to be abusing the reporting feature will receive one warning email and if the abuse continues will be banned from all online services provided by Falmouth Publishing.

Web Team Moderation: The capenews.net web team will continually monitor comments posted to the site and reserves the right to remove any comments that are not in line with our policies. Any users found to be abusing the comment feature will be banned from all online services provided by Falmouth Publishing.

Reasons comments will be removed include but are not limited to :

  • Off Topic-Comments that are not on topic with the current discussion thread or are otherwise meant to disrupt the discussion.
  • Spam-Any comments found to be advertisements.
  • Abusive-Any comments that are directly abusive to other users of the site.

All content is copyrighted by and remains the property of the Enterprise, except original photographs which are copyrighted by and remain the property of the owner. Reprints are for personal use only. Content may not be copied or reproduced in any manner without express permission in writing from the copyright holder and may not be used for publicity, promotion or advertising. Photo Contests

  • Photos must be submitted by the original photographer
  • Enterprise employees, and their families are ineligible to enter the contest.
  • The original photographer retains all rights to the works submitted while Falmouth Publishing retains the limited right to use all submitted photos in print and online including social media for the purpose of promoting this and future contests.
  • Limit of three submissions per photographer per contest.
  • Full resolution images must be available in order to win the contest.
  • Falmouth Publishing accepts no liability for any losses or damage resulting from entering any photo contest on capenews.net.
  • By entering Enterprise Photo Contests you agree to receive regular email updates from capenews.net

General. This Agreement contains the final and entire agreement between us regarding your use of the Services and supersedes all previous and contemporaneous oral or written agreements regarding your use of the Services. We may discontinue or change the Services, or their availability to you, at any time. This Agreement is personal to you, which means that you may not assign your rights or obligations under this Agreement to anyone. No third party is a beneficiary of this Agreement. You agree that this Agreement, as well as any and all claims arising from this Agreement will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States of America applicable to contracts made entirely within Massachusetts and wholly performed in Massachusetts, without regard to any conflict or choice of law principles. The sole jurisdiction and venue for any litigation arising out of this Agreement will be an appropriate federal or state court located in Massachusetts. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods.
